A crucial witness in the Elizabeth Holmes trial confirms the evidence against her

In an unprecedented court appearance on Monday, a crucial witness in the case that resulted in the conviction of disgraced Theranos CEO Elizabeth Holmes steadfastly defended his testimony. After the trial, Adam Rosendorff, the prosecution witness, made a contrite appearance at Holmes’ Silicon Valley home, raising concerns about possible wrongdoing.

The 38-year-old Holmes’ 75-minute hearing began on the same day she was due to be sentenced after being found guilty on four felony counts of investment fraud earlier this year. She is facing up to 20 years in prison for misrepresenting blood-testing technology to Thrernos investors, which she said would transform healthcare but which never performed as claimed.

If Holmes’ legal team can convince U.S. District Judge Edward Davila that she deserves a new trial based on the Rosendorff’s actions, Monday’s hearing might be her last chance to avoid prison. During Holmes’ trial last year, Rosendorff testified for the prosecution for six days on the witness stand.

Balwani and his co-defendant, Elizabeth Holmes, are charged with 12 counts of wire fraud and conspiracy to commit wire fraud arising out of their time as the Chief Operating Officer and Chief Executive Officer, respectively, of Theranos Inc. (“Theranos”), a health care and life sciences company offering blood testing technology. Theranos president Ramesh “Sunny” Balwani. Balwani was a top executive at Theranos and was also Holmes’ boyfriend at that time.
